Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Ishana mobile application and website at ishana.app (collectively, the "Service"), operated by Nithya Srinivasan, Fremont, California ("Ishana", "we", "our", or "us").

1. The Service

1.1 Description

Ishana is a mobile application that provides automated analysis of residential property entrance directions according to traditional Vastu Shastra and Feng Shui frameworks. The Service computes directional scores, displays satellite imagery with directional overlays, and provides AI-generated analysis of property layouts.

2.1 Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2.2 Account Creation

You may use limited features of the Service as a guest. To access saved analyses, unlimited AI co-pilot queries, and premium features, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

2.3 Account Termination

We may suspend or terminate your account at any time if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or used the Service in a way that could harm Ishana or other users.

3. Subscriptions and Payment

3.1 Free Tier

The free tier of the Service includes: entrance direction analysis for any US residential address, a basic Ishana Score based on entrance direction only, and limited AI Co-pilot queries (3 per day).

3.2 Premium Subscription

The premium subscription ("Ishana Premium") provides access to additional features including: the full 6-factor Vastu Score incorporating floor plan room analysis, unlimited AI Co-pilot queries, AI floor plan scanning, and future premium features as they are added. Subscription pricing is displayed in the app at the time of purchase.

3.3 Billing

Premium subscriptions are billed through the Apple App Store or Google Play Store (as applicable) using the payment method on file with your Apple or Google account. We do not directly handle payment card information. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period.

3.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple App Store or Google Play Store subscription settings. Cancellation takes effect at the end of the current billing period. We do not issue refunds for partial subscription periods except as required by applicable law or platform policies.

3.5 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Price changes will be communicated via email and in-app notification. Continued use of the Service after a price change constitutes acceptance of the new price.

4. User Conduct

4.1 Permitted Use

You may use the Service for personal, non-commercial purposes to research residential properties for potential purchase or rental, consistent with these Terms.

4.2 Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Scrape, crawl, or systematically download data from the Service using automated tools without our written consent.
• Attempt to reverse engineer, decompile, or extract the source code of the Service.
• Use the Service to harass, stalk, or harm any person.
• Submit false or misleading directional corrections with the intent to degrade the quality of the Community Directional Cache.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Use the Service to collect personal information about other users without their consent.
• Resell, sublicense, or otherwise commercially exploit any content or data from the Service without our written consent.

5. Intellectual Property

5.1 Ishana's Intellectual Property

The Service, including its software, user interface, design, algorithms, directional scoring methodology, Vastu analysis pipeline, and all content created by Ishana, is protected by copyright, trade secret, and patent laws. We own or license all intellectual property rights in the Service.

One or more patent applications covering the directional analysis technology incorporated in the Service are pending with the United States Patent and Trademark Office. All rights reserved.

5.2 Community Directional Cache Contributions

When you submit a directional correction, you grant Ishana a perpetual, worldwide, royalty-free, irrevocable license to use, store, process, and incorporate your correction into the Community Directional Cache and our AI training datasets. You represent that you are submitting corrections based on your genuine belief about the property's entrance direction and not for any improper purpose.

5.3 User Content

If you upload floor plan images or other content to the Service, you retain ownership of that content but grant us a limited license to process it for the purpose of providing the Service to you. We do not share your uploaded floor plan images with other users without your consent.

5.4 Third-Party Content

Satellite imagery displayed in the Service is provided by Mapbox and subject to their terms. Real estate listing information referenced by the Service is owned by respective listing providers. We do not claim ownership of third-party content.

6. Third-Party Services

The Service integrates with and displays content from third-party services including Mapbox (mapping), Anthropic Claude (AI analysis), Supabase (infrastructure), and real estate data providers. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

The Service may display links to external real estate listing platforms (Zillow, Redfin, Realtor.com, and others). These links are provided for convenience only. We are not affiliated with these platforms and do not endorse their listings or services.

8. Indemnification

You agree to indemnify, defend, and hold harmless Ishana and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

9. Dispute Resolution

9.1 Informal Resolution

Before filing a formal claim, you agree to contact us at contactus@ishana.app and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.

9.2 Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Alameda County, California.

9.3 Class Action Waiver

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceeding will be conducted on an individual basis and not in a class, consolidated, or representative action.

10. General Provisions

10.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Ishana regarding the Service and supersede all prior agreements.

10.2 Modifications

We may modify these Terms at any time by posting updated Terms in the app and on ishana.app. We will provide at least 14 days' notice before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

10.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

10.4 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.

10.5 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights under these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
